{"data":{"id":"us-ut/utah-code-7-1-1001","jurisdiction":"us-ut","citation":"Utah Code § 7-1-1001","heading":"Definitions -- Written consent or court order for disclosure by financial institution -- Exception.","body":"(1) As used in this part:\n(a) \"Account holder\" means a person for whom an account is held by a financial institution.\n(b) \"Governmental entity\" means:\n(i) the state, including:\n(A) a department;\n(B) an institution;\n(C) a board;\n(D) a division;\n(E) a bureau;\n(F) an office;\n(G) a commission;\n(H) a committee; or\n(I) an elected official; and\n(ii) a political subdivision of the state, including:\n(A) a county;\n(B) a city;\n(C) a town;\n(D) a school district;\n(E) a public transit district;\n(F) a redevelopment agency;\n(G) a special improvement district; or\n(H) a taxing district.\n(c) \"Nonprotected record\" means a record maintained by a financial institution to facilitate the conduct of the financial institution's business regarding a person or account, including:\n(i) the existence of an account;\n(ii) the opening and closing dates of an account;\n(iii) the name under which an account is held; and\n(iv) the name, address, and telephone number of an account holder.\n(d) \"Protected record\" means a record that is not defined as a nonprotected record.\n(e) \"Record\" means information that is:\n(i) prepared, owned, received, or retained by a financial institution;\n(ii)\n(A) inscribed on a tangible medium; or\n(B) stored in an electronic or other medium; and\n(iii) retrievable in perceivable form.\n(2) Except for a governmental entity listed in Subsection 7-1-1006(1), an individual acting on behalf of a governmental entity may not request, obtain by subpoena, or otherwise obtain information from a state or federally chartered financial institution that constitutes a record reflecting the financial condition of any person without first obtaining:\n(a) written permission from all account holders of the account referenced in the record to be examined; or\n(b) an order from a court of competent jurisdiction permitting access to the record.\n(3) This section does not apply to a review made by the commissioner to determine whether a financial institution is operating in accordance with law.","path":["Title 7 Financial Institutions Act","Chapter 7-1 General Provisions","Part 7-1-10 Financial Information Privacy"],"source_url":"https://le.utah.gov/xcode/Title7/Chapter1/7-1-S1001.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"af2f837f280da6519b8ab1122c5f8eea7ff66029e383104d5870b6c57798d5f9","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-7-1-901","next":"us-ut/utah-code-7-1-1002"},"notice":"GroundRules: Original legal text.
