{"data":{"id":"us-ut/utah-code-7-16a-203","jurisdiction":"us-ut","citation":"Utah Code § 7-16a-203","heading":"Contractual waiver of Uniform Commercial Code provisions.","body":"(1)\n(a) Subject to Subsections (1)(b) and (2), if the application of Title 70A, Uniform Commercial Code, is inconsistent with the operation of an automated teller machine, a point-of-sale terminal, or both, the requirements of Title 70A, Uniform Commercial Code, may be varied by contractual agreement of any:\n(i) depository institution;\n(ii) switching facility; or\n(iii) clearinghouse as defined by Section 70A-4-104.\n(b) A contractual agreement under Subsection (1)(a) may not disclaim responsibility for or limit the measure of damages for a depository institution's, switching facility's, or clearing house's:\n(i) lack of good faith; or\n(ii) failure to exercise ordinary care.\n(2) Notwithstanding Subsection (1)(a), the commissioner may, after notice and hearing, require rescission or modification of any provision of a contractual agreement permitted by Subsection (1)(a) if:\n(a) that provision relates to the rights and obligations of:\n(i) account holders of depository institutions;\n(ii) merchants;\n(iii) merchant customers; or\n(iv) others using or having access to automated teller machines, point-of-sale terminals, or both; and\n(b) the commissioner finds the provision is unconscionable or contrary to the public interest.","path":["Title 7 Financial Institutions Act","Chapter 7-16a Automated Teller Machine Act","Part 7-16a-2 Authority, Powers, Contractual Waiver, and Notification Requirements"],"source_url":"https://le.utah.gov/xcode/Title7/Chapter16a/7-16a-S203.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"1a45824a4a9a49a7d43f1dc4d192708f2439f6c8bcbb717f3114495a2b208506","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-7-16a-202","next":"us-ut/utah-code-7-16a-204"},"notice":"GroundRules: Original legal text.
