{"data":{"id":"us-ut/utah-code-7-23-501","jurisdiction":"us-ut","citation":"Utah Code § 7-23-501","heading":"Enforcement by department -- Rulemaking.","body":"(1) Subject to the requirements of Title 63G, Chapter 4, Administrative Procedures Act, the department may:\n(a) receive and act on complaints;\n(b) take action designed to obtain voluntary compliance with this chapter;\n(c) commence administrative or judicial proceedings on its own initiative to enforce compliance with this chapter; or\n(d) take action against a check casher or deferred deposit lender that fails to:\n(i) respond to the department, in writing within 30 business days of the day on which the check casher or deferred deposit lender receives notice from the department of a complaint filed with the department; or\n(ii) submit information as requested by the department.\n(2) The department may:\n(a) counsel persons and groups on their rights and duties under this chapter;\n(b) make rules in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, to:\n(i) restrict or prohibit lending or servicing practices that are misleading, unfair, or abusive;\n(ii) promote or assure fair and full disclosure of the terms and conditions of agreements and communications between a customer and:\n(A) a check casher; or\n(B) a deferred deposit lender; and\n(iii) promote or assure uniform application of or to resolve ambiguities in applicable state or federal laws or federal regulations; and\n(c) employ hearing examiners, clerks, and other employees and agents as necessary to perform the department's duties under this chapter.","path":["Title 7 Financial Institutions Act","Chapter 7-23 Check Cashing and Deferred Deposit Lending Registration Act","Part 7-23-5 Enforcement"],"source_url":"https://le.utah.gov/xcode/Title7/Chapter23/7-23-S501.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"b9c34a75c2dde77d80e27f621ee43ea263ff0cf87867491213dadf2ec6c9adeb","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-7-23-403","next":"us-ut/utah-code-7-23-502"},"notice":"GroundRules: Original legal text.
