{"data":{"id":"us-ut/utah-code-7-23-504","jurisdiction":"us-ut","citation":"Utah Code § 7-23-504","heading":"Penalties.","body":"(1) A person who violates this chapter or who files materially false information with a registration or renewal under Section 7-23-201 is:\n(a) guilty of a class B misdemeanor, except for a violation of:\n(i) Subsection 7-23-401(1)(f)(i), (ii), or (iii); or\n(ii) rules made under Subsection 7-23-501(2)(b); and\n(b) subject to revocation of a person's registration under this chapter.\n(2) Subject to Title 63G, Chapter 4, Administrative Procedures Act, if the department determines that a person is engaging in the business of cashing checks or the business of deferred deposit lending in violation of this chapter, the department may:\n(a) revoke that person's registration under this chapter;\n(b) issue a cease and desist order from committing any further violations;\n(c) prohibit the person from continuing to engage in the business of:\n(i) cashing checks; or\n(ii) deferred deposit lending;\n(d) impose an administrative fine not to exceed $1,000 per violation, except that:\n(i) a fine imposed under Subsection 7-23-201(4) shall comply with Subsection 7-23-201(4); and\n(ii) the aggregate total of fines imposed under this chapter against a person in a calendar year may not exceed $30,000 for that calendar year; or\n(e) take any combination of actions listed under this Subsection (2).","path":["Title 7 Financial Institutions Act","Chapter 7-23 Check Cashing and Deferred Deposit Lending Registration Act","Part 7-23-5 Enforcement"],"source_url":"https://le.utah.gov/xcode/Title7/Chapter23/7-23-S504.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"3f722d4e71c73cbed5407e45f0adf90a322907a46b81896eb6e30f3389dce2dc","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-7-23-503","next":"us-ut/utah-code-7-24-101"},"notice":"GroundRules: Original legal text.
