{"data":{"id":"us-ut/utah-code-7-26-401","jurisdiction":"us-ut","citation":"Utah Code § 7-26-401","heading":"Immunity.","body":"(1) A covered financial institution or a director, officer, employee, attorney, accountant, agent, or other representative of the covered financial institution:\n(a) has no duty to act under this chapter to protect a vulnerable adult from financial exploitation by a third person; and\n(b) is immune from all criminal, civil, and administrative liability for not taking a permissive action under this chapter.\n(2) A covered financial institution or a director, officer, employee, attorney, accountant, agent, or other representative of the covered financial institution who chooses to act as described in:\n(a) Subsection 7-26-201(2), is immune from all criminal, civil, and administrative liability for the act, unless the act is done in bad faith; and\n(b) Section 7-26-301 or 7-26-302, is immune from all criminal, civil, and administrative liability for the act, unless the act:\n(i) is done in bad faith; and\n(ii) causes pecuniary loss to a vulnerable adult suspected of being a victim of financial exploitation.\n(3) The immunity described in this section does not extend to an individual that is a principal, a conspirator, or an accessory after the fact to a criminal offense involving the financial exploitation of a vulnerable adult.","path":["Title 7 Financial Institutions Act","Chapter 7-26 Financial Exploitation Prevention Act","Part 7-26-4 Immunity"],"source_url":"https://le.utah.gov/xcode/Title7/Chapter26/7-26-S401.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"c27c5c83a9a81e096b5cc5ae009c474f477f41c05d5d7031569c829571d933ba","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-7-26-302","next":"us-ut/utah-code-7-27-101"},"notice":"GroundRules: Original legal text.
