{"data":{"id":"us-ut/utah-code-7-27-102","jurisdiction":"us-ut","citation":"Utah Code § 7-27-102","heading":"Application.","body":"The provisions of this chapter do not apply to:\n(1) a provider that is a depository institution;\n(2) a provider that is:\n(a)\n(i) a subsidiary of a depository institution; or\n(ii) a service corporation for a depository institution; and\n(b) regulated by a federal banking agency;\n(3) a provider that is regulated under the federal Farm Credit Act 12 U.S.C. Sec. 2001 et seq.;\n(4) a provider that is licensed as a money transmitter in accordance with Chapter 25, Money Transmitter Act;\n(5) a provider that consummates five or fewer commercial financing products in the state during any 12 month period;\n(6) a commercial financing transaction secured by real property;\n(7) a commercial financing transaction that is a lease as defined in Section 70A-2a-103;\n(8) a commercial financing transaction that is a purchase-money obligation as defined in Section 70A-9a-103;\n(9) a commercial financing transaction that:\n(a) involves a commercial loan or a commercial open-end credit plan;\n(b) is $50,000 or more; and\n(c) extends the commercial loan or the commercial open-end credit plan to:\n(i) a motor vehicle dealer or the motor vehicle dealer's affiliate; or\n(ii) a motor vehicle rental company as defined in Section 13-48-103 or the motor vehicle rental company's affiliate;\n(10) a commercial financing transaction offered by a person in connection with the sale of a product or service that:\n(a) the person manufactures, licenses, or distributes; or\n(b) the person's parent company or the person's owned and controlled subsidiary manufactures, licenses, or distributes; or\n(11) a commercial financing transaction of more than $1,000,000.","path":["Title 7 Financial Institutions Act","Chapter 7-27 Commercial Financing Registration and Disclosure Act","Part 7-27-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title7/Chapter27/7-27-S102.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"0249396058532d0ac9b441aa0473508d05b5e83b57f42f9ba654b76a2c726cf6","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-7-27-101","next":"us-ut/utah-code-7-27-201"},"notice":"GroundRules: Original legal text.
