{"data":{"id":"us-ut/utah-code-7-27-301","jurisdiction":"us-ut","citation":"Utah Code § 7-27-301","heading":"Penalties.","body":"(1) Subject to the requirements of Title 63G, Chapter 4, Administrative Procedures Act, the department may:\n(a) receive and act on complaints;\n(b) take action designed to obtain voluntary compliance with this chapter; or\n(c) commence administrative or judicial proceedings on the department's own initiative to enforce compliance with this chapter.\n(2) A person who violates a provision of this chapter is subject to a civil penalty of $500 per violation, not to exceed $20,000 for all violations arising from the use of the same transaction documentation or materials.\n(3) A person who violates a provision of this chapter after receiving written notice of a prior violation is subject to a civil penalty of $1,000 per violation, not to exceed $50,000 for all violations arising from the use of the same transaction documentation or materials.\n(4) Nothing in this chapter creates a private right of action against any person based on failure to comply with the provisions of this chapter.\n(5) A violation of this chapter does not affect the enforceability of any underlying agreement.","path":["Title 7 Financial Institutions Act","Chapter 7-27 Commercial Financing Registration and Disclosure Act","Part 7-27-3 Enforcement"],"source_url":"https://le.utah.gov/xcode/Title7/Chapter27/7-27-S301.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"c95850d198aa2d8a110fbdfc7625f8584aeebc8a8766de3cb5e4e557781c076c","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-7-27-202","next":"us-ut/utah-code-7-28-101"},"notice":"GroundRules: Original legal text.
