{"data":{"id":"us-ut/utah-code-7-28-108","jurisdiction":"us-ut","citation":"Utah Code § 7-28-108","heading":"When creditor process enforceable against bank.","body":"(1) Subject to Subsection (2), creditor process with respect to a special deposit is not enforceable against the bank holding the special deposit.\n(2) Creditor process is enforceable against the bank holding a special deposit with respect to an amount the bank is obligated to pay a beneficiary or a depositor if the process:\n(a) is served on the bank;\n(b) provides sufficient information to permit the bank to identify the depositor or the beneficiary from the bank's books and records; and\n(c) gives the bank a reasonable opportunity to act on the process.\n(3)\n(a) Creditor process served on a bank before the creditor process is enforceable against the bank under Subsection (2) does not create a right of the creditor against the bank or a duty of the bank to the creditor.\n(b) Other law determines whether creditor process creates a lien enforceable against the beneficiary on a contingent interest of a beneficiary, including a depositor as a beneficiary, even if not enforceable against the bank.","path":["Title 7 Financial Institutions Act","Chapter 7-28 Uniform Special Deposits Act","Part 7-28-1 Uniform Special Deposits Act"],"source_url":"https://le.utah.gov/xcode/Title7/Chapter28/7-28-S108.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"5a978f581b4b417eda39d53c27744ca53cd1c54b1962e9f5e37933d80dfdb433","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-7-28-107","next":"us-ut/utah-code-7-28-109"},"notice":"GroundRules: Original legal text.
