{"data":{"id":"us-ut/utah-code-70-3a-401","jurisdiction":"us-ut","citation":"Utah Code § 70-3a-401","heading":"Fraudulent registration.","body":"(1) A person is civilly liable to pay all damages resulting from a filing or registration under this chapter if:\n(a) that person procures the filing or registration of any mark:\n(i) for the person who procures the filing or registration; or\n(ii) on behalf of another person; and\n(b) the person who procures the filing or registration procures it by:\n(i) knowingly making a false or fraudulent representation or declaration, orally or in writing; or\n(ii) any other fraudulent means.\n(2) Damages sustained as a result of a filing or registration described in Subsection (1) may be recovered:\n(a) by or on behalf of the person injured by the filing or registration; and\n(b) in any court of competent jurisdiction.","path":["Title 70 Trademarks and Trade Names","Chapter 70-3a Registration and Protection of Trademarks and Service Marks Act","Part 70-3a-4 Violations and Remedies"],"source_url":"https://le.utah.gov/xcode/Title70/Chapter3a/70-3a-S401.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"01dcc018cb56e89db95da24118ff6c47971bb5776f57cac6cb57f3f3f137efd8","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-70-3a-309","next":"us-ut/utah-code-70-3a-402"},"notice":"GroundRules: Original legal text.
