{"data":{"id":"us-ut/utah-code-70d-3-202","jurisdiction":"us-ut","citation":"Utah Code § 70D-3-202","heading":"Qualifications for licensure.","body":"To qualify for a license under this chapter an individual shall comply with all of the following, the individual:\n(1) shall comply with 12 U.S.C. Sec. 5104 to register with and maintain a unique identifier through the nationwide database;\n(2) may not have had a loan originator license revoked in a governmental jurisdiction;\n(3) may not have been convicted of, or pled guilty or no contest to, a felony:\n(a) during the seven years preceding the day on which the individual files an application; or\n(b) at any time, if the felony involves an act of:\n(i) fraud;\n(ii) dishonesty;\n(iii) breach of trust; or\n(iv) money laundering;\n(4) shall demonstrate financial responsibility, character, and general fitness such as to:\n(a) command the confidence of the community; and\n(b) warrant a determination that the individual will operate as a loan originator honestly, fairly, and efficiently within the purposes of this chapter;\n(5) shall be covered by a surety bond posted in accordance with Section 70D-3-205;\n(6) shall complete the prelicensing education required by Section 70D-3-301; and\n(7) shall pass the written examination required by Section 70D-3-302.","path":["Title 70D Financial Institution Mortgage Financing Regulation Act","Chapter 70D-3 Financial Institution Loan Originator Licensing Act","Part 70D-3-2 Licensing Requirements and Procedures"],"source_url":"https://le.utah.gov/xcode/Title70D/Chapter3/70D-3-S202.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"9de13709a7a3ac8279f765e0e72a7c0cb66ffeb71e67f7172836cbf7659169c7","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-70d-3-201","next":"us-ut/utah-code-70d-3-203"},"notice":"GroundRules: Original legal text.
