{"data":{"id":"us-ut/utah-code-72-16-203","jurisdiction":"us-ut","citation":"Utah Code § 72-16-203","heading":"Rulemaking.","body":"(1) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, and the provisions of this chapter the committee may make rules:\n(a) establishing:\n(i) the form of an application and a renewal application for:\n(A) a qualified safety inspector certification;\n(B) an annual amusement ride permit; and\n(C) a multi-ride annual amusement ride permit;\n(ii) the procedure to apply for and renew:\n(A) a qualified safety inspector certification;\n(B) an annual amusement ride permit; and\n(C) a multi-ride annual amusement ride permit;\n(iii) standards for a daily inspection under Section 72-16-302;\n(iv) the form of a report of a reportable serious injury to the director;\n(v) the procedure for reporting a reportable serious injury to the director;\n(vi) the procedure to suspend and revoke:\n(A) a qualified safety inspector certification;\n(B) an annual amusement ride permit; and\n(C) a multi-ride annual amusement ride permit;\n(vii) a retention schedule that applies to each qualified safety inspector for records related to a qualified safety inspector's duties under this chapter;\n(viii) a retention schedule that applies to each owner-operator for records related to an owner-operator's duties under this chapter;\n(ix) fees;\n(x) minimum insurance requirements for certified inspectors; and\n(xi) fines or administrative penalties for lack of compliance with this chapter;\n(b) regarding the experience required to obtain a qualified safety inspector certification under Subsection 72-16-303(3)(a); and\n(c) adopting nationally recognized:\n(i) amusement ride inspection standards; and\n(ii) qualified safety inspector qualification standards.\n(2) Notwithstanding Subsection 63G-3-301(14), the committee shall initiate rulemaking proceedings, as defined in Section 63G-3-301, to make rules under this section.","path":["Title 72 Transportation Code","Chapter 72-16 Amusement Ride Safety Act","Part 72-16-2 Utah Amusement Ride Safety Committee"],"source_url":"https://le.utah.gov/xcode/Title72/Chapter16/72-16-S203.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"b721a0af8f57d9446835d68fba4b85249ea2b1dd5fb95b8eebcec9742b04784d","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-72-16-202","next":"us-ut/utah-code-72-16-204"},"notice":"GroundRules: Original legal text.
