{"data":{"id":"us-ut/utah-code-72-5-102","jurisdiction":"us-ut","citation":"Utah Code § 72-5-102","heading":"Definitions.","body":"As used in this part:\n(1) \"Public entity\" means the same as that term is defined in Section 72-2-201.\n(2) \"State institution of higher education\" means the same as that term is defined in Section 53B-3-102.\n(3) \"State transportation purposes\" includes:\n(a) highway, public transit facility, and transportation rights-of-way, including those necessary within cities and towns;\n(b) the construction, reconstruction, relocation, improvement, maintenance, and mitigation from the effects of these activities on state highways and other transportation facilities, including parking facilities, under the control of the department;\n(c) limited access facilities, including rights of access, air, light, and view and frontage and service roads to highways;\n(d) adequate drainage in connection with any highway, cut, fill, or channel change and the maintenance of any highway, cut, fill, or channel change;\n(e) weighing stations, shops, offices, storage buildings and yards, and road maintenance or construction sites;\n(f) road material sites, sites for the manufacture of road materials, and access roads to the sites;\n(g) the maintenance of an unobstructed view of any portion of a highway to promote the safety of the traveling public;\n(h) the placement of traffic signals, directional signs, and other signs, fences, curbs, barriers, and obstructions for the convenience of the traveling public;\n(i) the construction and maintenance of storm sewers, sidewalks, and highway illumination;\n(j) the construction and maintenance of livestock highways;\n(k) the construction and maintenance of roadside rest areas adjacent to or near any highway;\n(l) the mitigation of impacts from transportation projects; and\n(m) any other transportation purpose for which the department has responsibility under this title.","path":["Title 72 Transportation Code","Chapter 72-5 Rights-Of-Way Act","Part 72-5-1 Public Highways"],"source_url":"https://le.utah.gov/xcode/Title72/Chapter5/72-5-S102.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"c72651025fe18901c10f0a20c15f54a127c8d913b3cf06484096a714bd15e6e2","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-72-5-101","next":"us-ut/utah-code-72-5-103"},"notice":"GroundRules: Original legal text.
