{"data":{"id":"us-ut/utah-code-72-6-106.5","jurisdiction":"us-ut","citation":"Utah Code § 72-6-106.5","heading":"Reuse of industrial byproducts.","body":"(1) As used in this section:\n(a) \"Director\" is as defined in Section 19-6-1102.\n(b) \"Industrial byproduct\" has the same meaning as defined in Section 19-6-1102.\n(c) \"Public project\" has the same meaning as defined in Section 19-6-1102.\n(d) \"Reuse\" has the same meaning as defined in Section 19-6-1102.\n(2) Consistent with the protection of public health and the environment and generally accepted engineering practices, the department shall, to the maximum extent possible considering budgetary factors:\n(a) allow and encourage the reuse of an industrial byproduct in:\n(i) a plan, specification, and estimate for a public project; and\n(ii) advertising for a bid for a public project;\n(b) allow for the reuse of an industrial byproduct in, among other uses:\n(i) landscaping;\n(ii) a general geotechnical fill;\n(iii) a structural fill;\n(iv) concrete or asphalt;\n(v) a base or subbase; and\n(vi) geotechnical drainage materials; and\n(c) promulgate and apply public project specifications that allow reuse of an industrial byproduct based upon:\n(i) cost;\n(ii) performance; and\n(iii) engineered equivalency in lifespan, durability, and maintenance.\n(3) After the director issues an approval under Section 19-6-1104 and the department uses the industrial byproduct in compliance with the director's approval:\n(a) the department is not responsible for further management of the industrial byproduct; and\n(b) the generator or originator of the industrial byproduct is not responsible for the industrial byproduct under Title 19, Environmental Quality Code.","path":["Title 72 Transportation Code","Chapter 72-6 Construction, Maintenance, and Operations Act","Part 72-6-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title72/Chapter6/72-6-S106.5.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"6d989226f3f9ec98d1f68cd22b141b34cc6c2e8909711025f4dd4f81b6c7aec6","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-72-6-106","next":"us-ut/utah-code-72-6-107"},"notice":"GroundRules: Original legal text.
