{"data":{"id":"us-ut/utah-code-73-2-1.6","jurisdiction":"us-ut","citation":"Utah Code § 73-2-1.6","heading":"Water Rights Restricted Account.","body":"(1) As used in this section:\n(a) \"Account\" means the Water Rights Restricted Account created by this section.\n(b) \"Division\" means the Division of Water Rights.\n(2) There is created in the General Fund a restricted account known as the \"Water Rights Restricted Account.\"\n(3) The account shall consist of the money deposited into the account under Subsection 59-12-103(4)(b).\n(4) Upon appropriation, the division may use money in the account for:\n(a) costs incurred by the division that benefit water rights adjudications, including:\n(i) employing technical staff;\n(ii) acquiring equipment;\n(iii) conducting studies;\n(iv) installing, operating, and maintaining measurement infrastructure; and\n(v) sharing the costs of installed United States Geological Survey stream gauges;\n(b) not to exceed 5% of the money deposited into the account under Subsection 59-12-103(4)(b) in the fiscal year preceding the fiscal year of appropriation, costs incurred by the division to acquire, manage, and analyze surface and groundwater data, not limited to geographic areas of adjudication; and\n(c) costs incurred by the division to obtain legal support, not limited to geographic areas of adjudication.\n(5)\n(a) The account may not exceed $8,000,000 at the end of a fiscal year.\n(b) If the account exceeds $8,000,000 at the end of a fiscal year, the Division of Finance shall deposit into the Water Resources Conservation and Development Fund, created in Section 73-10-24, the money in excess of the amount necessary to maintain the account balance at $8,000,000.","path":["Title 73 Water and Irrigation","Chapter 73-2 State Engineer - Division of Water Rights"],"source_url":"https://le.utah.gov/xcode/Title73/Chapter2/73-2-S1.6.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"0ac4b934e000d7e45752a30e077857a630d1cb2435bb3d2d12c7e7b5ac67c049","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-73-2-1.5","next":"us-ut/utah-code-73-2-2"},"notice":"GroundRules: Original legal text.
