{"data":{"id":"us-ut/utah-code-73-2-27","jurisdiction":"us-ut","citation":"Utah Code § 73-2-27","heading":"Criminal penalties.","body":"(1) This section applies to offenses committed under:\n(a) Section 73-1-14;\n(b) Section 73-1-15;\n(c) Section 73-2-20;\n(d) Section 73-3-3;\n(e) Section 73-3-26;\n(f) Section 73-3-29;\n(g) Section 73-5-9;\n(h) Section 76-9-1202;\n(i) Section 76-9-1203; and\n(j) Section 76-9-1204.\n(2) Under circumstances not amounting to an offense with a greater penalty under Subsection 76-6-106(2)(a)(ii), Section 76-6-106.3, or Section 76-6-404, violation of a provision listed in Subsection (1) is punishable:\n(a) as a felony of the third degree if:\n(i) the value of the water diverted or property damaged or taken is $2,500 or greater; and\n(ii) the person violating the provision has previously been convicted of violating the same provision;\n(b) as a class A misdemeanor if:\n(i) the value of the water diverted or property damaged or taken is $2,500 or greater; or\n(ii) the person violating the provision has previously been convicted of violating the same provision; or\n(c) as a class B misdemeanor if Subsection (2)(a) or (b) does not apply.","path":["Title 73 Water and Irrigation","Chapter 73-2 State Engineer - Division of Water Rights"],"source_url":"https://le.utah.gov/xcode/Title73/Chapter2/73-2-S27.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"b21d33fbb66c68b78bd3dbae611b4de7a8d7666b62be880b2b2db0bdd5756530","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-73-2-26","next":"us-ut/utah-code-73-2-28"},"notice":"GroundRules: Original legal text.
