{"data":{"id":"us-ut/utah-code-73-31-205","jurisdiction":"us-ut","citation":"Utah Code § 73-31-205","heading":"Review of statutory bank application.","body":"(1) After complying with Sections 73-31-203 and 73-31-204, the board shall approve an application if the application satisfies Section 73-31-202, which is to be liberally interpreted by the board to facilitate the objectives described in Section 73-31-104.\n(2) In approving an application, the board shall:\n(a) issue an order approving the statutory water bank;\n(b) approve persons to serve as the initial members of the governing body in accordance with the proposed statutory water bank's structure and Section 73-31-202; and\n(c) publish the approved application on the water banking website.\n(3) If the board denies an application, the board shall issue a written explanation to the applicant that sets forth the reason for denial, provided that the board's decision regarding an application does not create a right of appeal under Title 63G, Chapter 4, Administrative Procedures Act.","path":["Title 73 Water and Irrigation","Chapter 73-31 Water Banking Act","Part 73-31-2 Statutory Water Banks"],"source_url":"https://le.utah.gov/xcode/Title73/Chapter31/73-31-S205.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"0905db3850857262ecec84a68aead33f43d54cf4a04fd79c7ed97aa8fc8e4ab2","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-73-31-204","next":"us-ut/utah-code-73-31-206"},"notice":"GroundRules: Original legal text.
