{"data":{"id":"us-ut/utah-code-73-3b-201","jurisdiction":"us-ut","citation":"Utah Code § 73-3b-201","heading":"Application for a recharge permit -- Required information -- Filing fee.","body":"(1) The application for obtaining a recharge permit shall include the following information:\n(a) the name and mailing address of the applicant;\n(b) the name of the groundwater basin or groundwater sub-basin in which the applicant proposes to operate the recharge project;\n(c) the name and mailing address of the owner of the land on which the applicant proposes to operate the recharge project;\n(d) a legal description of the location of the proposed recharge project;\n(e) the source and annual quantity of water proposed to be artificially recharged;\n(f) evidence of a water right or an agreement to use the water proposed to be artificially recharged;\n(g) the quality of the water proposed to be artificially recharged and the water quality of the receiving aquifer;\n(h) evidence that the applicant has applied for all applicable water quality permits;\n(i) a plan of operation for the proposed recharge project, which shall include:\n(i) a description of the proposed recharge project;\n(ii) its design capacity;\n(iii) a detailed monitoring program; and\n(iv) the proposed duration of the recharge project;\n(j) a copy of a study demonstrating:\n(i) the area of hydrologic impact of the recharge project;\n(ii) that the recharge project is hydrologically feasible;\n(iii) that the recharge project will not:\n(A) cause unreasonable harm to land; or\n(B) impair any existing water right within the area of hydrologic impact; and\n(iv) the percentage of anticipated recoverable water;\n(k) evidence of financial and technical capability; and\n(l) any other information that the state engineer requires.\n(2)\n(a) A filing fee must be submitted with the application.\n(b) The state engineer shall establish the filing fee in accordance with Section 63J-1-504.","path":["Title 73 Water and Irrigation","Chapter 73-3b Groundwater Recharge and Recovery Act","Part 73-3b-2 Recharge and Recovery Permits"],"source_url":"https://le.utah.gov/xcode/Title73/Chapter3b/73-3b-S201.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"85d521ff0c633de74b3143182157d96d7cbc6a255845a8096d782cdc924b91a8","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-73-3b-107","next":"us-ut/utah-code-73-3b-202"},"notice":"GroundRules: Original legal text.
