{"data":{"id":"us-ut/utah-code-73-5a-702","jurisdiction":"us-ut","citation":"Utah Code § 73-5a-702","heading":"Civil penalties -- Costs -- Civil liability.","body":"(1) Any person who violates this chapter or any lawful notice or order issued pursuant to this chapter shall be assessed a penalty not to exceed $5,000 per violation in a civil proceeding.\n(2) In the case of a continuing violation, each day that the violation continues constitutes a separate and distinct offense.\n(3) Any person who violates this chapter shall be liable for any expenses incurred by the state engineer in abating any violation of this chapter.\n(4) A penalty assessment under this chapter does not relieve the person assessed from civil liability for claims arising out of any act which was also a violation.","path":["Title 73 Water and Irrigation","Chapter 73-5a Dam Safety","Part 73-5a-7 Enforcement and Penalties"],"source_url":"https://le.utah.gov/xcode/Title73/Chapter5a/73-5a-S702.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"cef25263fba217df918c4b11abfa23bcd0ae571d615ce8b3b1f528c407eb8c7c","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-73-5a-701","next":"us-ut/utah-code-73-6-1"},"notice":"GroundRules: Original legal text.
