{"data":{"id":"us-ut/utah-code-75-2-1207","jurisdiction":"us-ut","citation":"Utah Code § 75-2-1207","heading":"Prospective application.","body":"(1)\n(a) Except as extended by Subsection (2), this section applies to a nonvested property interest or a power of appointment that is created on or after December 31, 2003.\n(b) For purposes of this section, a nonvested property interest or a power of appointment created by the exercise of a power of appointment is created when:\n(i) the power is irrevocably exercised; or\n(ii) a revocable exercise becomes irrevocable.\n(2) If a nonvested property interest or a power of appointment was created before December 31, 2003, and is determined in a judicial proceeding, commenced on or after December 31, 2003, to violate Utah's rule against perpetuities as that rule existed before December 31, 2003, a court upon the petition of an interested person may reform the disposition:\n(a) in the manner that most closely approximates the transferor's manifested plan of distribution; and\n(b) that is within the limits of the rule against perpetuities applicable when the nonvested property interest or power of appointment was created.\n(3) Section 75-2-1203 applies to a trust instrument or conveyance executed on or after December 31, 2003, if the trust instrument or conveyance creates a contingent power of appointment or nonvested property interest subject to the exercise of a power of appointment that creates a new or successive power of appointment.","path":["Title 75 Utah Uniform Probate Code","Chapter 75-2 Intestate Succession and Wills","Part 75-2-12 Statutory Rule Against Perpetuities"],"source_url":"https://le.utah.gov/xcode/Title75/Chapter2/75-2-S1207.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"1f905b19e4a66deb79218455792f398008c708ec2c205bdad0574ac9b3461e6d","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-75-2-1206.5","next":"us-ut/utah-code-75-2-1208"},"notice":"GroundRules: Original legal text.
