{"data":{"id":"us-ut/utah-code-75-2-1405","jurisdiction":"us-ut","citation":"Utah Code § 75-2-1405","heading":"Execution of an electronic will.","body":"(1) Subject to Subsection 75-2-1408(4) and except as provided in Section 75-2-1406, an electronic will shall be:\n(a) a record that is readable as text at the time of signing under Subsection (1)(b);\n(b) signed:\n(i) by the testator; or\n(ii) in the testator's name by some other individual in the testator's conscious presence and by the testator's direction; and\n(c) signed in the physical or electronic presence of the testator by at least two individuals within a reasonable time after witnessing:\n(i) the signing of the will under Subsection (1)(b); or\n(ii) the testator's acknowledgment of the signing of the will under Subsection (1)(b) or the testator's acknowledgment of the will.\n(2) Intent of a testator that the record under Subsection (1)(a) be the testator's electronic will may be established by extrinsic evidence.","path":["Title 75 Utah Uniform Probate Code","Chapter 75-2 Intestate Succession and Wills","Part 75-2-14 Uniform Electronic Wills Act"],"source_url":"https://le.utah.gov/xcode/Title75/Chapter2/75-2-S1405.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"1f6d567b5c98fa16cc87422e47fad158018a87ccc24c3fe40bcd59f89a640ca1","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-75-2-1404","next":"us-ut/utah-code-75-2-1406"},"notice":"GroundRules: Original legal text.
