{"data":{"id":"us-ut/utah-code-75a-2-116","jurisdiction":"us-ut","citation":"Utah Code § 75A-2-116","heading":"Judicial relief.","body":"(1) The following persons may petition a court to construe a power of attorney or review the agent's conduct and grant appropriate relief:\n(a) the principal or the agent;\n(b) a guardian, conservator, or other fiduciary acting for the principal;\n(c) a person authorized to make health care decisions for the principal;\n(d) the principal's spouse, parent as defined in Section 75-1-201, or descendant;\n(e) an individual who would qualify as a presumptive heir of the principal;\n(f) a person named as a beneficiary to receive any property, benefit, or contractual right on the principal's death or as a beneficiary of a trust created by or for the principal that has a financial interest in the principal's estate;\n(g) a governmental agency having regulatory authority to protect the welfare of the principal;\n(h) the principal's caregiver or another person that demonstrates sufficient interest in the principal's welfare; and\n(i) a person asked to accept the power of attorney.\n(2) Upon motion by the principal, the court shall dismiss a petition filed under this section, unless the court finds that the principal lacks capacity to revoke the agent's authority or the power of attorney.","path":["Title 75A Fiduciaries","Chapter 75A-2 Uniform Power of Attorney Act","Part 75A-2-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title75A/Chapter2/75A-2-S116.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"855251eab4605ac09d3f82e341050786396d97cccbc0f7286e6de2d73c148cfe","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-75a-2-115","next":"us-ut/utah-code-75a-2-117"},"notice":"GroundRules: Original legal text.
