{"data":{"id":"us-ut/utah-code-75a-5-306","jurisdiction":"us-ut","citation":"Utah Code § 75A-5-306","heading":"Unitrust rate.","body":"(1) Except as otherwise provided in Subsection 75A-5-309(2)(a), a unitrust rate may be:\n(a) a fixed unitrust rate; or\n(b) a unitrust rate that is determined for each period using:\n(i) a market index or other published data; or\n(ii) a mathematical blend of market indices or other published data over a stated number of preceding periods.\n(2) Except as otherwise provided in Subsection 75A-5-309(2)(a), a unitrust policy may provide:\n(a) a limit on how high the unitrust rate determined under Subsection (1)(b) may rise;\n(b) a limit on how low the unitrust rate determined under Subsection (1)(b) may fall;\n(c) a limit on how much the unitrust rate determined under Subsection (1)(b) may increase over the unitrust rate for the preceding period or a mathematical blend of unitrust rates over a stated number of preceding periods;\n(d) a limit on how much the unitrust rate determined under Subsection (1)(b) may decrease below the unitrust rate for the preceding period or a mathematical blend of unitrust rates over a stated number of preceding periods; or\n(e) a mathematical blend of any of the unitrust rates determined under Subsection (1)(b) and Subsections (2)(a) through (d).","path":["Title 75A Fiduciaries","Chapter 75A-5 Uniform Fiduciary Income and Principal Act","Part 75A-5-3 Unitrust"],"source_url":"https://le.utah.gov/xcode/Title75A/Chapter5/75A-5-S306.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"30cb054d6cd2b1296168f35b7586ee2ca2999da05a2dccfd93c97db958ff6f45","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-75a-5-305","next":"us-ut/utah-code-75a-5-307"},"notice":"GroundRules: Original legal text.
