{"data":{"id":"us-ut/utah-code-75a-5-309","jurisdiction":"us-ut","citation":"Utah Code § 75A-5-309","heading":"Special tax benefits -- Other rules.","body":"(1) A unitrust policy may:\n(a) provide methods and standards for:\n(i) determining the timing of distributions;\n(ii) making distributions in cash or in kind or partly in cash and partly in kind; or\n(iii) correcting an underpayment or overpayment to a beneficiary based on the unitrust amount if there is an error in calculating the unitrust amount;\n(b) specify sources and the order of sources, including categories of income for federal income tax purposes, from which distributions of a unitrust amount are paid; or\n(c) provide other standards and rules the fiduciary determines serve the interests of the beneficiaries.\n(2) If a trust qualifies for a special tax benefit or a fiduciary is not an independent person:\n(a) the unitrust rate established under Section 75A-5-306 may not be less than 3% or more than 5%;\n(b) the only provisions of Section 75A-5-307 that apply are Subsections 75A-5-307(1) and (2)(a), (d), (e)(i), and (i);\n(c) the only period that may be used under Section 75A-5-308 is a calendar year under Subsection 75A-5-308(1); and\n(d) the only other provisions of Section 75A-5-308 that apply are Subsections 75A-5-308(2)(b)(i) and (c).","path":["Title 75A Fiduciaries","Chapter 75A-5 Uniform Fiduciary Income and Principal Act","Part 75A-5-3 Unitrust"],"source_url":"https://le.utah.gov/xcode/Title75A/Chapter5/75A-5-S309.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"34aa5ce1800a31fe696e16d47921ad6f4437c49d58df44906bd67c93bb7bdd2b","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-75a-5-308","next":"us-ut/utah-code-75a-5-401"},"notice":"GroundRules: Original legal text.
