{"data":{"id":"us-ut/utah-code-75b-2-1012","jurisdiction":"us-ut","citation":"Utah Code § 75B-2-1012","heading":"Protection of person dealing with trustee.","body":"(1) A person other than a beneficiary who in good faith assists a trustee, or who in good faith and for value deals with a trustee, without knowledge that the trustee is exceeding or improperly exercising the trustee's powers is protected from liability as if the trustee properly exercised the power.\n(2) A person other than a beneficiary who in good faith deals with a trustee is not required to inquire into the extent of the trustee's powers or the propriety of the trustee's exercise.\n(3) A person who in good faith delivers assets to a trustee need not ensure the assets' proper application.\n(4) A person other than a beneficiary who in good faith assists a former trustee, or who in good faith and for value deals with a former trustee, without knowledge that the trusteeship has terminated is protected from liability as if the former trustee were still a trustee.\n(5) Comparable protective provisions of other laws relating to commercial transactions or transfer of securities by fiduciaries prevail over the protection provided by this section.","path":["Title 75B Trusts","Chapter 75B-2 Uniform Trust Code","Part 75B-2-10 Liability of Trustees and Rights of Persons Dealing with Trustee"],"source_url":"https://le.utah.gov/xcode/Title75B/Chapter2/75B-2-S1012.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"274710f6238e7c956200049168aa8cdfb486217c9c072c6fb54968d5bc216848","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-75b-2-1011","next":"us-ut/utah-code-75b-2-1013"},"notice":"GroundRules: Original legal text.
