{"data":{"id":"us-ut/utah-code-75b-2-401","jurisdiction":"us-ut","citation":"Utah Code § 75B-2-401","heading":"Methods of creating trust.","body":"(1) A trust may be created by:\n(a) transfer of property to another person as trustee during the settlor's lifetime or by will or other disposition taking effect upon the settlor's death;\n(b) declaration by the owner of property that the owner holds identifiable property as trustee; or\n(c) exercise of a power of appointment in favor of a trustee.\n(2)\n(a) A health savings account is established on the first day an individual is covered by a high deductible health plan, as defined in Section 223 of the Internal Revenue Code.\n(b) The health savings account shall be opened with a trustee or custodian within the time prescribed by law, without extensions, for filing a federal income tax return for that year.\n(c) A health savings account is established regardless of a transfer of cash or other property to the account and, unless required by the trustee or custodian, it is not necessary for any party to sign a health savings account trust or custodial agreement regarding the health savings account.","path":["Title 75B Trusts","Chapter 75B-2 Uniform Trust Code","Part 75B-2-4 Creation, Validity, Modification, and Termination of a Trust"],"source_url":"https://le.utah.gov/xcode/Title75B/Chapter2/75B-2-S401.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"a98700d20bd867e53d345f707e54b01dbbc0a871fb44f8c45f3f446983f06ada","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-75b-2-305","next":"us-ut/utah-code-75b-2-402"},"notice":"GroundRules: Original legal text.
