{"data":{"id":"us-ut/utah-code-75b-3-107","jurisdiction":"us-ut","citation":"Utah Code § 75B-3-107","heading":"Limitations on trust director.","body":"(1) A trust director is subject to the same rules as a trustee in a like position and under similar circumstances in the exercise or nonexercise of a power of direction or further power under Subsection 75B-3-106(2)(a) regarding:\n(a) a payback provision in the terms of a trust necessary to comply with the Medicaid reimbursement requirements in Section 1917 of the Social Security Act, 42 U.S.C. Sec. 1396p(d)(4)(A), as amended, and any related regulations; and\n(b) a charitable interest in the trust, including notice regarding the interest to the attorney general.\n(2) A trust director may not engage in trust business, as that term is defined in Section 7-5-101.","path":["Title 75B Trusts","Chapter 75B-3 Uniform Directed Trust Act"],"source_url":"https://le.utah.gov/xcode/Title75B/Chapter3/75B-3-S107.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"81fd40b801639ed65b64c88b1fd4853db36ab0b93d3d332fa1204d3a785ecbb1","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-75b-3-106","next":"us-ut/utah-code-75b-3-108"},"notice":"GroundRules: Original legal text.
