{"data":{"id":"us-ut/utah-code-75e-11-302","jurisdiction":"us-ut","citation":"Utah Code § 75E-11-302","heading":"Eligibility.","body":"(1) An applicant is eligible to participate in the program if the applicant attests that the applicant:\n(a) is a resident of this state;\n(b)\n(i) is a victim;\n(ii) is a parent or a guardian of an individual who:\n(A) is a victim; and\n(B) resides at the same address as the parent or guardian;\n(iii) resides at the same address where a victim resides; or\n(iv) fears for the applicant's physical safety, or for the physical safety of a minor or incapacitated individual residing at the same address as the applicant, from a threat of abuse, domestic violence, human trafficking, stalking, or sexual assault;\n(c)\n(i) resided at a residential address that was known by an assailant and relocated within the past 90 days to a different residential address that is not known by the assailant;\n(ii) resides at a residential address known by the assailant and intends to relocate within 90 days to a different residential address in the state that is not known by the assailant; or\n(iii) resides at a residential address that is not known by the assailant;\n(d) will not disclose the different residential address to the assailant; and\n(e) will benefit from participation in the program.\n(2) An applicant may participate in the program regardless of whether:\n(a) a criminal charge is filed against an assailant;\n(b) the applicant has a restraining order or injunction against an assailant; or\n(c) the applicant reported an act or threat by an assailant to a law enforcement agency or officer.\n(3) An applicant may participate in the program only upon the recommendation of a program assistant.\n(4) To participate in the program:\n(a) an applicant shall sign, date, and verify the information on an application; and\n(b) the department shall verify the applicant's current residential address as provided on the application.\n(5) A parent or guardian may act on behalf of a minor or an incapacitated individual in determining whether the minor or the incapacitated individual is eligible for the program.","path":["Title 75E Criminal and Juvenile Justice Administration","Chapter 75E-11 Safe At Home Program","Part 75E-11-3 Program Administration"],"source_url":"https://le.utah.gov/xcode/Title75E/Chapter11/75E-11-S302.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"e8e71b2188e5f313bc88a8e088b937edb899db1bdccdcd507865b9d13e5d4f37","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-75e-11-301","next":"us-ut/utah-code-75e-11-303"},"notice":"GroundRules: Original legal text.
