{"data":{"id":"us-ut/utah-code-75e-2-209","jurisdiction":"us-ut","citation":"Utah Code § 75E-2-209","heading":"Judicial selection -- Rulemaking.","body":"The department shall:\n(1) enact rules establishing procedures for the meetings of a judicial nominating commission created under Section 78A-10a-302, 78A-10a-402, or 78A-10a-502 in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act; and\n(2) ensure that the rules described in Subsection (1):\n(a) comply with the requirements of Title 78A, Chapter 10a, Judicial Selection;\n(b) include standards that:\n(i) maintain the confidentiality of applications for a judicial vacancy and related documents;\n(ii) address destroying the records of the names of applicants, applications, and related documents upon the completion of the judicial nomination process; and\n(iii) govern a judicial nominating commission member's disqualification and inability to serve;\n(c) allow for public comment concerning the judicial nomination process, qualifications for judicial office, and individual applicants;\n(d) include evaluation criteria for the selection of judicial nominees; and\n(e) address procedures for:\n(i) taking summary minutes at a judicial nominating commission meeting;\n(ii) simultaneously forwarding the names of nominees to the governor, the president of the Senate, and the Office of Legislative Research and General Counsel as described in Subsection 78A-10a-203(5); and\n(iii) requiring the Administrative Office of the Courts to immediately inform the governor when a judge is removed, resigns, or retires.","path":["Title 75E Criminal and Juvenile Justice Administration","Chapter 75E-2 Department Of Criminal Justice","Part 75E-2-2 Department Responsibilities"],"source_url":"https://le.utah.gov/xcode/Title75E/Chapter2/75E-2-S209.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"3ca1baf58b750bcecdcd42ac6d52c67d6d42323d28d7a936f4dc4c0daa158151","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-75e-2-208","next":"us-ut/utah-code-75e-2-210"},"notice":"GroundRules: Original legal text.
