{"data":{"id":"us-ut/utah-code-75e-7-102","jurisdiction":"us-ut","citation":"Utah Code § 75E-7-102","heading":"Domestic Violence Offender Treatment Board -- Creation -- Membership -- Quorum -- Per diem -- Staff support -- Meetings.","body":"(1) There is created within the department the Domestic Violence Offender Treatment Board consisting of the following members:\n(a) the executive director of the Department of Corrections, or the executive director's designee;\n(b) the executive director of the Department of Health and Human Services, or the executive director's designee;\n(c) one individual who represents a state program that focuses on prevention of injury and domestic violence appointed by the executive director of the Department of Health and Human Services;\n(d) the commissioner of public safety for the Department of Public Safety, or the commissioner's designee;\n(e) the chair of the Victim Services Commission or the chair's designee;\n(f) the director of the Office for Victims of Crime, or the director's designee;\n(g) the chair of the Board of Pardons and Parole, or the chair's designee;\n(h) the director of the Division of Juvenile Justice and Youth Services, or the director's designee;\n(i) one individual who represents the Administrative Office of the Courts appointed by the state court administrator; and\n(j) ten individuals appointed by the executive director of the commission, including:\n(i) the following four individuals licensed under Title 58, Chapter 60, Mental Health Professional Practice Act:\n(A) a clinical social worker;\n(B) a marriage and family therapist;\n(C) a professional counselor; and\n(D) a psychologist;\n(ii) one individual who represents an association of criminal defense attorneys;\n(iii) one criminal defense attorney who primarily represents indigent criminal defendants;\n(iv) one individual who represents an association of prosecuting attorneys;\n(v) one individual who represents law enforcement;\n(vi) one individual who represents an association of criminal justice victim advocates; and\n(vii) one individual who represents a nonprofit organization that provides domestic violence victim advocate services.\n(2)\n(a) A member may not serve on the board for more than eight consecutive years.\n(b) If a vacancy occurs in the membership of the board appointed under Subsection (1), the member shall be replaced in the same manner in which the original appointment was made.\n(c) A member of the board serves until the member's successor is appointed.\n(3) The members of the board shall vote on a chair and co-chair of the board to serve for two years.\n(4)\n(a) A majority of the board members constitutes a quorum.\n(b) The action of a majority of a quorum constitutes an action of the board.\n(5) A board member may not receive compensation or benefits for the member's service on the board, but may receive per diem and reimbursement for travel expenses incurred as a board member at the rates established by the Division of Finance under:\n(a) Sections 63A-3-106 and 63A-3-107; and\n(b) rules made by the Division of Finance under Sections 63A-3-106 and 63A-3-107.\n(6) The commission shall provide staff support to the board.\n(7) The board shall meet at least quarterly on a date the board sets.","path":["Title 75E Criminal and Juvenile Justice Administration","Chapter 75E-7 Domestic Violence Offender Treatment Board","Part 75E-7-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title75E/Chapter7/75E-7-S102.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"afd085d21cbc9ec09ee3cdd3b10de04271a18ad8bed60af020eb89af8222b19f","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-75e-7-101","next":"us-ut/utah-code-75e-7-201"},"notice":"GroundRules: Original legal text.
