{"data":{"id":"us-ut/utah-code-76-12-203","jurisdiction":"us-ut","citation":"Utah Code § 76-12-203","heading":"Unlawful electronic disclosure of personal identifying information.","body":"(1)\n(a) As used in this section, \"personal identifying information\" means the same as that term is defined in Section 76-6-1101.\n(b) Terms defined in Sections 76-1-101.5, 76-12-101, and 76-12-201 apply to this section.\n(2) An actor commits unlawful electronic disclosure of personal identifying information if the actor:\n(a)\n(i) electronically publishes, posts, or otherwise discloses personal identifying information of another individual in a public online site or forum without the permission of the other individual; and\n(ii) undertakes the action described in Subsection (2)(a)(i) with the intent to abuse, threaten, or disrupt the other individual's electronic communication; or\n(b) sends a communication by electronic mail, instant message, or other similar means, if:\n(i) the communication references personal identifying information of another individual;\n(ii) the actor sends the communication:\n(A) without the individual's consent; and\n(B) with the intent to cause a recipient of the communication to reasonably believe that the individual authorized or sent the communication; and\n(iii) with the intent to:\n(A) cause an individual physical, emotional, or economic injury or damage; or\n(B) defraud an individual.\n(3)\n(a) Except as provided in Subsection (3)(b), a violation of Subsection (2) is a class B misdemeanor.\n(b) A second or subsequent violation of Subsection (2) is a class A misdemeanor.\n(4)\n(a) Except as provided in Subsection (4)(b), a criminal prosecution under this section does not affect an individual's right to bring a civil action for damages suffered as a result of the commission of an offense under this section.\n(b) This section does not create a civil cause of action based on an electronic communication made for a legitimate business purpose.","path":["Title 76 Criminal Offenses","Chapter 76-12 Offenses Related to Privacy, Information, and Communication","Part 76-12-2 Electronic Communication Abuse"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter12/76-12-S203.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"0625d31a0b9960519b497d6eac170f5b054882c15f69cc665a8cad6deaab7b56","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-12-202","next":"us-ut/utah-code-76-12-204"},"notice":"GroundRules: Original legal text.
