{"data":{"id":"us-ut/utah-code-76-12-309","jurisdiction":"us-ut","citation":"Utah Code § 76-12-309","heading":"Loitering in a privacy space.","body":"(1)\n(a) As used in this section:\n(i) \"Privacy space\" means the following in which an individual has a reasonable expectation of privacy:\n(A) a restroom or any other space that includes a toilet;\n(B) a dressing room, fitting room, locker room, changing facility, or any other space designated for multiple individuals to dress or undress within the same space; or\n(C) any room or space that includes a shower.\n(ii) \"Sex-designated\" means that a facility, program, or event is designated specifically for males or females and not the opposite sex.\n(b) Terms defined in Sections 76-1-101.5, 76-12-101, and 76-12-301 apply to this section.\n(2) An actor commits the offense loitering in a privacy space if the actor intentionally or knowingly remains unlawfully in a privacy space.\n(3)\n(a) Except as provided in Subsection (3)(b), a violation of Subsection (2) is a class B misdemeanor.\n(b) A violation of Subsection (2) is a class A misdemeanor if the actor commits the offense:\n(i) while also committing the offense of:\n(A) criminal trespass in a sex-designated changing room under Subsection 76-6-206(2)(d);\n(B) lewdness under Section 76-5-419;\n(C) lewdness involving a child under Section 76-5-420; or\n(D) voyeurism under Section 76-12-306;\n(E) recorded or photographed voyeurism under Section 76-12-307; or\n(F) distribution of images obtained through voyeurism under Section 76-12-308; or\n(ii) in a sex-designated privacy space that is not designated for individuals of the actor's sex.","path":["Title 76 Criminal Offenses","Chapter 76-12 Offenses Related to Privacy, Information, and Communication","Part 76-12-3 Privacy Offenses"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter12/76-12-S309.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"2904d424947c478925165c2f84b72d897a27aaeca1ce43d736966eabd05f7d6a","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-12-308","next":"us-ut/utah-code-76-12-401"},"notice":"GroundRules: Original legal text.
