{"data":{"id":"us-ut/utah-code-76-12-402","jurisdiction":"us-ut","citation":"Utah Code § 76-12-402","heading":"Unlawful use of a person's name for soliciting contributions.","body":"(1) Terms defined in Sections 76-1-101.5, 76-12-101, and 76-12-401 apply to this section.\n(2) An actor commits unlawful use of a person's name for soliciting contributions if the actor:\n(a) is a charitable organization, professional fund raiser, or professional solicitor, seeking to raise funds for a charitable purpose; and\n(b) uses the name of any other person for the purpose of soliciting a charitable contribution in this state without the written consent of the person.\n(3) A violation of Subsection (2) is an infraction.\n(4) This section does not apply to:\n(a) a religious corporation, organization, charity, or agency; or\n(b) an organization operated, supervised, or controlled by or in connection with a religious corporation or organization.","path":["Title 76 Criminal Offenses","Chapter 76-12 Offenses Related to Privacy, Information, and Communication","Part 76-12-4 Offenses Involving Charitable Solicitations"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter12/76-12-S402.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"09004ca7d772b829e7f3115489be23771d6de198fddce633cf4ef58581727380","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-12-401","next":"us-ut/utah-code-76-12-403"},"notice":"GroundRules: Original legal text.
