{"data":{"id":"us-ut/utah-code-76-18-405","jurisdiction":"us-ut","citation":"Utah Code § 76-18-405","heading":"Unlawful distribution or possession with intent to distribute an imitation controlled substance.","body":"(1) Terms defined in Sections 76-1-101.5, 76-18-101, and 76-18-401 apply to this section.\n(2) An actor commits unlawful distribution or possession with intent to distribute an imitation controlled substance if the actor:\n(a) distributes an imitation controlled substance; or\n(b) possesses an imitation controlled substance with the intent to distribute the imitation controlled substance.\n(3) Subject to Subsection (4), a violation of Subsection (2) is a class A misdemeanor.\n(4) A violation of this section is subject to the penalties and classifications under Section 76-18-204, Enhanced penalties and sentencing for certain drug offenses, if the trier of fact finds the elements described under Section 76-18-204.\n(5) If a minor is found by a court to have violated this section, the court may order the minor to complete:\n(a) a screening as defined in Section 41-6a-501;\n(b) an assessment as defined in Section 41-6a-501 if the screening described in Subsection (5)(a) indicates that an assessment is appropriate; or\n(c) an educational series as defined in Section 41-6a-501 or substance use disorder treatment as indicated by an assessment described in Subsection (5)(b).","path":["Title 76 Criminal Offenses","Chapter 76-18 Drug Offenses","Part 76-18-4 Offenses Concerning Imitation Controlled Substances"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter18/76-18-S405.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"f352b494eb19f84f654779c20b44c3618f3d454da987846e4b7720cfea8306a8","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-18-404","next":"us-ut/utah-code-76-18-406"},"notice":"GroundRules: Original legal text.
