{"data":{"id":"us-ut/utah-code-76-3-203.21","jurisdiction":"us-ut","citation":"Utah Code § 76-3-203.21","heading":"Transnational repression enhancement.","body":"(1) As used in this section:\n(a) \"Agent of a foreign government\" means an individual who acts at the direction of, under the control of, or as a proxy for, a foreign government.\n(b) \"Agent of a foreign terrorist organization\" means an individual who acts at the direction of, under the control of, or as a proxy for, a foreign terrorist organization designated by the federal government in accordance with 8 U.S.C. Sec. 1189.\n(2) An actor who commits any criminal offense is subject to an enhanced penalty for the offense as provided in Subsection (3) if the trier of fact finds beyond a reasonable doubt that the actor:\n(a)\n(i) is an agent of a foreign government or an agent of a foreign terrorist organization; or\n(ii) acted at the direction, request, command, or otherwise under the influence of, a foreign government or foreign terrorist organization; and\n(b) committed the criminal offense with the intent to:\n(i)\n(A) cause an individual to act on behalf of a foreign government or foreign terrorist organization;\n(B) cause an individual to leave the United States or cause another individual to leave the United States; or\n(C) compel the victim to do any other act against the victim's will; or\n(ii) compel the victim to refrain from doing any act against the victim's will.\n(3) For an offense described in Subsection (2), the actor may be charged as follows:\n(a) for a class C misdemeanor, as a class B misdemeanor;\n(b) for a class B misdemeanor, as a class A misdemeanor;\n(c) for a class A misdemeanor, as a third degree felony;\n(d) for a third degree felony, as a second degree felony; and\n(e) for a second degree felony, as a first degree felony.","path":["Title 76 Criminal Offenses","Chapter 76-3 Punishments","Part 76-3-2 Sentencing"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter3/76-3-S203.21.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"26f800f20e3cfacdfb6c710b17549d4a12300c51f0b10156c5744cd5d0112222","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-3-203.20","next":"us-ut/utah-code-76-3-204"},"notice":"GroundRules: Original legal text.
