{"data":{"id":"us-ut/utah-code-76-5-102.8","jurisdiction":"us-ut","citation":"Utah Code § 76-5-102.8","heading":"Disarming a peace officer -- Penalties.","body":"(1)\n(a) As used in this section:\n(i) \"Conductive energy device\" means a weapon that uses electrical current to disrupt voluntary control of muscles.\n(ii) \"Firearm\" means the same as that term is defined in Section 76-11-101.\n(b) Terms defined in Section 76-1-101.5 apply to this section.\n(2) An actor commits disarming a peace officer if the actor intentionally takes or removes, or attempts to take or remove a firearm or a conductive energy device from an individual or immediate presence of an individual who the actor knows is a peace officer:\n(a) without the consent of the peace officer; and\n(b) while the peace officer is acting within the scope of the peace officer's authority as a peace officer.\n(3)\n(a) A violation of Subsection (2) regarding a firearm is a first degree felony.\n(b) A violation of Subsection (2) regarding a conductive energy device is a third degree felony.","path":["Title 76 Criminal Offenses","Chapter 76-5 Offenses Against the Individual","Part 76-5-1 Assault and Related Offenses"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter5/76-5-S102.8.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"8bce5817d19384da803a0fde1e4606a92490412c9f964070599d4f8dc33dd13f","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-5-102.7","next":"us-ut/utah-code-76-5-102.9"},"notice":"GroundRules: Original legal text.
