{"data":{"id":"us-ut/utah-code-76-5-115","jurisdiction":"us-ut","citation":"Utah Code § 76-5-115","heading":"Leaving a child unattended in a motor vehicle.","body":"(1)\n(a) As used in this section:\n(i) \"Child\" means an individual who is younger than nine years old.\n(ii) \"Enclosed compartment\" means any enclosed area of a motor vehicle, including the passenger compartment, regardless of whether a door, window, or hatch is left open.\n(iii) \"Motor vehicle\" means an automobile, truck, truck tractor, bus, or any other self-propelled vehicle.\n(b) Terms defined in Section 76-1-101.5 apply to this section.\n(2) An actor commits leaving a child unattended in a motor vehicle if:\n(a) the actor intentionally, knowingly, recklessly, or with criminal negligence leaves a child in an enclosed compartment of a motor vehicle;\n(b) the motor vehicle is on:\n(i) public property; or\n(ii) private property that is open to the general public;\n(c) the child is not supervised by an individual who is at least nine years old; and\n(d) the conditions present a risk to the child of:\n(i) hyperthermia;\n(ii) hypothermia; or\n(iii) dehydration.\n(3) A violation of Subsection (2) is a class C misdemeanor.\n(4) This section does not apply if the actor's conduct that constitutes a violation of this section is subject to a greater penalty under another provision of state law.\n(5) This section preempts enforcement of a local law or ordinance that makes it an infraction or a criminal offense to engage in the conduct that constitutes a misdemeanor under this section.\n(6) Notwithstanding any provision of state law to the contrary, a conviction under this section may not be used by a state or local government entity as grounds for revoking, refusing to grant, or refusing to renew, a license or permit, including a license or permit relating to the provision of day care or child care.","path":["Title 76 Criminal Offenses","Chapter 76-5 Offenses Against the Individual","Part 76-5-1 Assault and Related Offenses"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter5/76-5-S115.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"8bee7e5ca6f2918beace911b610331cfd03c000d9ffbf72d5cb62ca553d8343c","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-5-114","next":"us-ut/utah-code-76-5-201"},"notice":"GroundRules: Original legal text.
