{"data":{"id":"us-ut/utah-code-76-5-201","jurisdiction":"us-ut","citation":"Utah Code § 76-5-201","heading":"Criminal homicide -- Designations of offenses -- Exceptions -- Application of consensual altercation defense.","body":"(1)\n(a) As used in this section:\n(i) \"Abortion\" means the same as that term is defined in Section 76-7-301.\n(ii) \"Criminal homicide\" means an act causing the death of another human being, including an unborn child at any stage of the unborn child's development.\n(b) The terms defined in Section 76-1-101.5 apply to this section.\n(2) The following are criminal homicide:\n(a) aggravated murder;\n(b) murder;\n(c) manslaughter;\n(d) child abuse homicide;\n(e) homicide by assault;\n(f) negligent homicide; and\n(g) automobile homicide.\n(3) Notwithstanding Subsection (2), an actor is not guilty of criminal homicide if:\n(a) the death of an unborn child is caused by an abortion;\n(b) the sole reason for the death of an unborn child is that the actor:\n(i) refused to consent to:\n(A) medical treatment; or\n(B) a cesarean section; or\n(ii) failed to follow medical advice; or\n(c) a woman causes the death of her own unborn child, and the death:\n(i) is caused by a criminally negligent act or reckless act of the woman; and\n(ii) is not caused by an intentional or knowing act of the woman.\n(4) The provisions governing a defense of a consensual altercation as described in Section 76-5-104 apply to this part.","path":["Title 76 Criminal Offenses","Chapter 76-5 Offenses Against the Individual","Part 76-5-2 Criminal Homicide"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter5/76-5-S201.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"47e05a69ef7a71b8b03baf92c56430fd8a22066c00b13e4f407eeeba93662e1b","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-5-115","next":"us-ut/utah-code-76-5-202"},"notice":"GroundRules: Original legal text.
