{"data":{"id":"us-ut/utah-code-76-5-208","jurisdiction":"us-ut","citation":"Utah Code § 76-5-208","heading":"Child abuse homicide -- Penalties.","body":"(1)\n(a) As used in this section, \"child abuse\" means an offense described in Section 76-5-109, 76-5-109.2, 76-5-109.3, or 76-5-114.\n(b) Terms defined in Section 76-1-101.5 apply to this section.\n(2) Unless a violation amounts to aggravated murder as described in Section 76-5-202, an actor commits child abuse homicide if:\n(a)\n(i) the actor causes the death of another individual who is younger than 18 years old; and\n(ii) the individual's death results from child abuse; and\n(b)\n(i) the child abuse is done recklessly under Subsection 76-5-109.2(3)(b);\n(ii) the child abuse is done with criminal negligence under Subsection 76-5-109.2(3)(c); or\n(iii) under circumstances not amounting to the type of child abuse homicide described in Subsection (2)(b)(i), the child abuse is done intentionally, knowingly, recklessly, or with criminal negligence, under Subsection 76-5-109(3)(a), (b), or (c).\n(3)\n(a) A violation of Subsection (2) under the circumstances described in Subsection (2)(b)(i) is a first degree felony.\n(b) A violation of Subsection (2) under the circumstances described in Subsection (2)(b)(ii) or (iii) is a second degree felony.","path":["Title 76 Criminal Offenses","Chapter 76-5 Offenses Against the Individual","Part 76-5-2 Criminal Homicide"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter5/76-5-S208.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"89f3774de7405a86ba5a7bab9267b1cadd401e290d8372a322cff1a0f0e55c03","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-5-207.5","next":"us-ut/utah-code-76-5-209"},"notice":"GroundRules: Original legal text.
