{"data":{"id":"us-ut/utah-code-76-5-301","jurisdiction":"us-ut","citation":"Utah Code § 76-5-301","heading":"Kidnapping.","body":"(1)\n(a) As used in this section:\n(i) \"Against the will of an individual\" includes without the consent of the legal guardian, caretaker, or custodian of an individual who is a dependent adult.\n(ii) \"Dependent adult\" means the same as that term is defined in Section 76-5-111.\n(iii) \"Minor\" means an individual who is 14 years old or older but younger than 18 years old.\n(b) Terms defined in Section 76-1-101.5 apply to this section.\n(2) An actor commits kidnapping if the actor intentionally or knowingly, without authority of law, and against the will of an individual:\n(a) detains or restrains the individual for any substantial period of time;\n(b) detains or restrains the individual in circumstances exposing the individual to risk of bodily injury;\n(c) holds the individual in involuntary servitude;\n(d) detains or restrains a minor without the consent of the minor's parent or legal guardian or the consent of a person acting in loco parentis; or\n(e) moves the individual any substantial distance or across a state line.\n(3) A violation of Subsection (2) is a second degree felony.","path":["Title 76 Criminal Offenses","Chapter 76-5 Offenses Against the Individual","Part 76-5-3 Kidnapping, Trafficking, And Smuggling"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter5/76-5-S301.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"e8d0324fa90e54555db338dd33a7eb4f5146ac4bc56710b7d501c8536d19433e","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-5-211","next":"us-ut/utah-code-76-5-301.1"},"notice":"GroundRules: Original legal text.
