{"data":{"id":"us-ut/utah-code-76-5-314","jurisdiction":"us-ut","citation":"Utah Code § 76-5-314","heading":"Patronizing a child victim of human labor trafficking.","body":"(1)\n(a) As used in this section:\n(i) \"Child\" means an individual who is younger than 18 years old.\n(ii) \"Commercial sexual act\" means the same as that term is defined in Section 76-5-308.1.\n(iii) \"Commercial sexually explicit performance\" means the same as that term is defined in Section 76-5-308.1.\n(iv) \"Fraud\" means the same as that term is defined in Section 76-5-308.\n(b) Terms defined in Section 76-1-101.5 apply to this section.\n(2) An actor commits patronizing a child victim of labor exploitation if:\n(a) the actor knowingly requests or accepts services or labor from an individual;\n(b) the services or labor described in Subsection (2)(a) is not a commercial sexual act or a commercial sexually explicit performance;\n(c) the actor knows, is reckless, or is criminally negligent as to whether, the individual described in Subsection (2)(a) is a child;\n(d) the individual described in Subsection (2)(a) is a child; and\n(e) the actor:\n(i) knows the individual's services or labor is being provided as a result of another person's exercise of force, fraud, or coercion over the individual;\n(ii) is reckless as to whether the individual's services or labor is being provided as a result of another person's exercise of force, fraud, or coercion over the individual; or\n(iii) is criminally negligent as to whether the individual's services or labor is being provided as a result of another person's exercise of force, fraud, or coercion over the individual.\n(3)\n(a) A violation of Subsection (2)(e)(i) is a second degree felony.\n(b)\n(i) Except as provided in Subsection (3)(b)(ii), a violation of Subsection (2)(e)(ii) is a third degree felony.\n(ii) A violation of Subsection (2)(e)(ii) is a second degree felony on a second or any subsequent conviction for a violation of Subsection (2)(e)(ii).\n(c)\n(i) Except as provided in Subsection (3)(c)(ii), a violation of Subsection (2)(e)(iii) is a class A misdemeanor.\n(ii) A violation of Subsection (2)(e)(iii) is a third degree felony on a second or any subsequent conviction for a violation of Subsection (2)(e)(iii).","path":["Title 76 Criminal Offenses","Chapter 76-5 Offenses Against the Individual","Part 76-5-3 Kidnapping, Trafficking, And Smuggling"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter5/76-5-S314.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"ed1ff09bc93b3d8db608db655e74c58632ef9727572a9811130186d4445910f5","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-5-313","next":"us-ut/utah-code-76-5-315"},"notice":"GroundRules: Original legal text.
