{"data":{"id":"us-ut/utah-code-76-5-316","jurisdiction":"us-ut","citation":"Utah Code § 76-5-316","heading":"Human smuggling.","body":"(1)\n(a) As used in this section:\n(i) \"Commercial purpose\" includes direct or indirect participation in, or facilitation of, the transportation of one or more individuals for the purpose of:\n(A) charging or obtaining a fee, or attempting to charge or obtain a fee, for the transportation; or\n(B) obtaining, exchanging, or receiving, or attempting to obtain, exchange, or receive, any thing or item of value.\n(ii) \"Facilitation of the transportation\" includes providing:\n(A) travel arrangement services;\n(B) payment for the costs of travel; or\n(C) property that would advance an act of transportation, including:\n(I) a vehicle or other means of transportation;\n(II) a weapon;\n(III) false identification; or\n(IV) making lodging available, including by rent, lease, or sale.\n(b) Terms defined in Section 76-1-101.5 apply to this section.\n(2) An actor commits human smuggling if the actor transports or procures the transportation for one or more individuals for a commercial purpose, knowing or having reason to know that the individual or individuals transported or to be transported are not:\n(a) citizens of the United States;\n(b) permanent resident aliens; or\n(c) otherwise lawfully in this state or entitled to be in this state.\n(3) A violation of Subsection (2) is a second degree felony.\n(4) An offense committed under this section is a separate offense from any other offense committed in relationship to the commission of an offense under this section.","path":["Title 76 Criminal Offenses","Chapter 76-5 Offenses Against the Individual","Part 76-5-3 Kidnapping, Trafficking, And Smuggling"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter5/76-5-S316.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"2566fdbb37af5f87b6201a42da18ffe095241d185ff769c23d874ddd7df75b87","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-5-315","next":"us-ut/utah-code-76-5-317"},"notice":"GroundRules: Original legal text.
