{"data":{"id":"us-ut/utah-code-76-5-418","jurisdiction":"us-ut","citation":"Utah Code § 76-5-418","heading":"Sexual battery.","body":"(1) Terms defined in Section 76-1-101.5 apply to this section.\n(2) An actor commits sexual battery if, under circumstances not amounting to an offense described in Subsection (4):\n(a) the actor intentionally touches, whether or not through clothing:\n(i) the anus, buttocks, or any part of the genitals of another individual; or\n(ii) the breast of a female individual; and\n(b) the actor's conduct is under circumstances that the actor knows or should know will likely cause affront or alarm to the individual touched.\n(3) A violation of Subsection (2) is a class A misdemeanor.\n(4) The offenses referred to in Subsection (2) are:\n(a) rape under Section 76-5-402;\n(b) rape of a child under Section 76-5-402.1;\n(c) object rape under Section 76-5-402.2;\n(d) object rape of a child under Section 76-5-402.3;\n(e) forcible sodomy under Section 76-5-403;\n(f) sodomy on a child under Section 76-5-403.1;\n(g) forcible sexual abuse under Section 76-5-404;\n(h) sexual abuse of a child under Section 76-5-404.1;\n(i) aggravated sexual abuse of a child under Section 76-5-404.3;\n(j) aggravated sexual assault under Section 76-5-405; and\n(k) an attempt to commit an offense under this Subsection (4).","path":["Title 76 Criminal Offenses","Chapter 76-5 Offenses Against the Individual","Part 76-5-4 Sexual Offenses"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter5/76-5-S418.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"4141464fc7afe3109245886b0a95b76e081b0ca1481ca86877a7b7d1b7956a32","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-5-417","next":"us-ut/utah-code-76-5-419"},"notice":"GroundRules: Original legal text.
