{"data":{"id":"us-ut/utah-code-76-5-704","jurisdiction":"us-ut","citation":"Utah Code § 76-5-704","heading":"Civil cause of action.","body":"(1) An individual upon whom female genital mutilation was performed may bring a civil action in any court of competent jurisdiction for female genital mutilation any time within 10 years of:\n(a) the procedure being performed; or\n(b) the victim's 18th birthday.\n(2) The court may award actual, compensatory, and punitive damages, and any other appropriate relief.\n(3) A prevailing plaintiff shall be awarded attorney fees and costs.\n(4) Treble damages may be awarded if the plaintiff proves the defendant's acts were willful and malicious.\n(5) If a health care provider is charged and prosecuted for a violation of Section 76-5-702, Section 78B-3-416 may not apply to an action against the health care provider under this section.","path":["Title 76 Criminal Offenses","Chapter 76-5 Offenses Against the Individual","Part 76-5-7 Genital Mutilation"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter5/76-5-S704.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"777a400931f3e90184c59140a2b01c37a586b2f9f927e36dd06ec7f1fd8c5fdb","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-5-702","next":"us-ut/utah-code-76-5-801"},"notice":"GroundRules: Original legal text.
