{"data":{"id":"us-ut/utah-code-76-5d-208","jurisdiction":"us-ut","citation":"Utah Code § 76-5d-208","heading":"Aggravated exploitation of prostitution.","body":"(1) Terms defined in Sections 76-1-101.5, 76-5d-101, and 76-5d-201 apply to this section.\n(2) An actor commits aggravated exploitation of prostitution if:\n(a) in committing an act of exploitation of prostitution as described in Section 76-5d-207, the actor uses any force, threat, or fear against any individual;\n(b) the individual whom the actor procured, transported, or persuaded or with whom the actor shares the proceeds of prostitution, is a child or is the spouse of the actor; or\n(c) in the course of committing an act of exploitation of prostitution as described in Section 76-5d-207, the actor commits human trafficking or human smuggling in violation of Section 76-5-308, 76-5-308.1, 76-5-308.5, 76-5-308.6, 76-5-310, 76-5-310.2, 76-5-311,76-5-312, 76-5-316, or 76-5-317.\n(3)\n(a) Except as provided in Subsection (3)(b), a violation of Subsection (2) is a second degree felony.\n(b) A violation of Subsection (2) is a first degree felony if the violation involves a child.\n(4) Upon a conviction for a violation of this section, the court shall order the maximum fine amount and may not waive or suspend the fine.","path":["Title 76 Criminal Offenses","Chapter 76-5d Prostitution","Part 76-5d-2 General Offenses"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter5d/76-5d-S208.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"8f43e5040dad0b448b6a84d8b2f0313656281c5ee7b9fdab8115628f2612cd21","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-5d-207","next":"us-ut/utah-code-76-5d-209"},"notice":"GroundRules: Original legal text.
