{"data":{"id":"us-ut/utah-code-76-6-1105","jurisdiction":"us-ut","citation":"Utah Code § 76-6-1105","heading":"Unlawful possession of another's identification documents.","body":"(1)\n(a) As used in this section:\n(i)\n(A) \"Identifying document\" means:\n(I) a government issued document commonly used for identification;\n(II) a vehicle registration certificate; or\n(III) any other document, image, data file, or medium containing personal identifying information as defined in Subsection 76-6-1101(1)(a).\n(B) \"Identifying document\" includes:\n(I) a counterfeit identifying document; or\n(II) a document containing personal identifying information of a deceased individual.\n(ii) \"Possess\" means to have physical control or electronic access.\n(b) Terms defined in Sections 76-1-101.5 and 76-6-1101 apply to this section.\n(2)\n(a) Under circumstances that do not constitute a violation of Section 76-6-502 or 76-6-1102, an actor commits unlawful possession of another's identification documents if the actor:\n(i) obtains or possesses an identifying document:\n(A) with knowledge that the actor is not entitled to obtain or possess the identifying document; or\n(B) with intent to deceive or defraud; or\n(ii) assists another person in obtaining or possessing an identifying document:\n(A) with knowledge that the person is not entitled to obtain or possess the identifying document; or\n(B) with knowledge that the person intends to use the identifying document to deceive or defraud.\n(b) Under circumstances that do not constitute a violation of Section 76-6-502 or 76-6-1102, an actor commits unlawful possession of another's identification documents if the actor:\n(i) obtains or possesses identifying documents of more than two, but fewer than 100, individuals:\n(A) with knowledge that the individual is not entitled to obtain or possess the identifying documents; or\n(B) with intent to deceive or defraud; or\n(ii) assists another person in obtaining or possessing identifying documents of more than two, but fewer than 100, individuals:\n(A) with knowledge that the person is not entitled to obtain or possess the multiple identifying documents; or\n(B) with knowledge that the person intends to use the identifying documents to deceive or defraud.\n(c) Under circumstances that do not constitute a violation of Section 76-6-502 or 76-6-1102, an actor commits unlawful possession of another's identification documents if the actor:\n(i) obtains or possesses identifying documents of 100 or more individuals:\n(A) with knowledge that the individual is not entitled to obtain or possess the identifying documents; or\n(B) with intent to deceive or defraud; or\n(ii) assists another person in obtaining or possessing identifying documents of 100 or more individuals:\n(A) with knowledge that the person is not entitled to obtain or possess the identifying documents; or\n(B) with knowledge that the person intends to use the identifying documents to deceive or defraud.\n(3) A violation of:\n(a) Subsection (2)(a) is a class A misdemeanor;\n(b) Subsection (2)(b) is a third degree felony; or\n(c) Subsection (2)(c) is a second degree felony.","path":["Title 76 Criminal Offenses","Chapter 76-6 Offenses Against Property","Part 76-6-11 Identity Fraud Act"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter6/76-6-S1105.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"6d5bf9f80b337214931fd85e1ab82eb7880e97beaf05d25489deb850a5fd842c","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-6-1104","next":"us-ut/utah-code-76-6-1202"},"notice":"GroundRules: Original legal text.
