{"data":{"id":"us-ut/utah-code-76-6-1408","jurisdiction":"us-ut","citation":"Utah Code § 76-6-1408","heading":"Falsification of seller's statement to dealer.","body":"(1) Terms defined in Sections 76-1-101.5 and 76-6-1402 apply to this section.\n(2) An actor commits falsification of seller's statement to dealer if the actor:\n(a) sells, offers to sell, or attempts to sell regulated metal; and\n(b) in providing information required by Section 76-6-1403, 76-6-1405, or 76-6-1406 willfully makes a false statement or provides any untrue information.\n(3)\n(a)\n(i) Except as provided in Subsection (3)(b), a violation of Subsection (2) is a class B misdemeanor.\n(ii) An actor who is convicted of a class B misdemeanor under this section is subject to a mandatory fine of no less than $1,000.\n(b)\n(i) A violation of Subsection (2) is a class A misdemeanor if the actor previously has been convicted of a violation of this section.\n(ii) An actor who is convicted of a class A misdemeanor under this section is subject to a mandatory fine of no less than $2,500.","path":["Title 76 Criminal Offenses","Chapter 76-6 Offenses Against Property","Part 76-6-14 Regulation of Metal Dealers"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter6/76-6-S1408.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"014b03c74ea1ab1325a22c5b02c5ecc288f1844d6023fe61cb36c5a140db9370","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-6-1406.1","next":"us-ut/utah-code-76-6-1409"},"notice":"GroundRules: Original legal text.
