{"data":{"id":"us-ut/utah-code-76-6-202","jurisdiction":"us-ut","citation":"Utah Code § 76-6-202","heading":"Burglary.","body":"(1) Terms defined in Sections 76-1-101.5 and 76-6-201 apply to this section.\n(2) An actor commits burglary if the actor enters or remains unlawfully in a building or any portion of a building with intent to commit:\n(a) a felony;\n(b) theft;\n(c) an assault on any person;\n(d) lewdness, in violation of Section 76-5-419;\n(e) sexual battery, in violation of Section 76-5-418;\n(f) lewdness involving a child, in violation of Section 76-5-420;\n(g) voyeurism, in violation of Section 76-12-306;\n(h) recorded or photographed voyeurism, in violation of Section 76-12-307; or\n(i) distribution of images obtained through voyeurism, in violation of Section 76-12-308.\n(3)\n(a) Except as provided in Subsection (3)(b), a violation of Subsection (2) is a third degree felony.\n(b) A violation of Subsection (2) is a second degree felony if the violation is committed in a dwelling.\n(4) A violation of this section is a separate offense from any of the offenses listed in Subsections (2)(a) through (i), and which may be committed by the actor while in the building.","path":["Title 76 Criminal Offenses","Chapter 76-6 Offenses Against Property","Part 76-6-2 Burglary and Criminal Trespass"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter6/76-6-S202.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"c83814c272087fd10953773b7735c8f08cf29434e2734726283828a6c2467a37","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-6-201","next":"us-ut/utah-code-76-6-202.2"},"notice":"GroundRules: Original legal text.
