{"data":{"id":"us-ut/utah-code-76-6-409.6","jurisdiction":"us-ut","citation":"Utah Code § 76-6-409.6","heading":"Use of telecommunication device to avoid lawful charge for service.","body":"(1) Terms defined in Sections 76-1-101.5 and 76-6-409.5 apply to this section.\n(2) An actor commits use of a telecommunication device to avoid lawful charge for service if the actor uses a telecommunication device:\n(a) with the intent to avoid the payment of a lawful charge for telecommunication service; or\n(b) with the knowledge that the use of the telecommunication device was to avoid the payment of a lawful charge for telecommunication service.\n(3)\n(a) A violation of Subsection (2) is:\n(i) a class B misdemeanor, if the value of the telecommunication service is less than $300 or cannot be ascertained;\n(ii) a class A misdemeanor, if the value of the telecommunication service charge is or exceeds $300 but is not more than $1,000;\n(iii) a third degree felony, if the value of the telecommunication service is or exceeds $1,000 but is not more than $5,000; or\n(iv) a second degree felony, if:\n(A) the value of the telecommunication service is or exceeds $5,000;\n(B) the cloned cellular telephone was used to facilitate the commission of a felony; or\n(C) the actor previously has been convicted of a violation of this section.\n(b) An actor who violates this section is subject to the restitution and civil action provisions described in Section 76-6-409.10.","path":["Title 76 Criminal Offenses","Chapter 76-6 Offenses Against Property","Part 76-6-4 Theft"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter6/76-6-S409.6.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"9189ac7d5652535646450b984c5945c59c03cddfad77f1736931e3dc0cff7d2f","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-6-409.5","next":"us-ut/utah-code-76-6-409.7"},"notice":"GroundRules: Original legal text.
