{"data":{"id":"us-ut/utah-code-76-8-1303","jurisdiction":"us-ut","citation":"Utah Code § 76-8-1303","heading":"Unlawful failure to comply with Employment Security Act requirement.","body":"(1) Terms defined in Sections 76-1-101.5 and 76-8-101 apply to this section.\n(2) An actor commits unlawful failure to comply with Employment Security Act requirements if the actor willfully:\n(a) fails or refuses:\n(i) to make a contribution or other payment required under Title 35A, Chapter 4, Employment Security Act;\n(ii) to furnish a report required under Title 35A, Chapter 4, Employment Security Act; or\n(iii) to produce or permit the inspection or copying of records required under Title 35A, Chapter 4, Employment Security Act; or\n(b) violates a provision of Title 35A, Chapter 4, Employment Security Act, or an order made under that chapter, for which the violation:\n(i) is made unlawful or the observance of which is required under the terms of Title 35A, Chapter 4, Employment Security Act;\n(ii) does not have a prescribed penalty in Title 35A, Chapter 4, Employment Security Act, or another applicable statute; and\n(iii) is for conduct not described in Subsection (2)(a).\n(3)\n(a) A violation of Subsection (2)(a) is:\n(i) a class B misdemeanor if the value of the money obtained or sought to be obtained is less than $500;\n(ii) a class A misdemeanor if the value of the money obtained or sought to be obtained is or exceeds $500 but is less than $1,500;\n(iii) a third degree felony if the value of the money obtained or sought to be obtained is or exceeds $1,500 but is less than $5,000; or\n(iv) a second degree felony if the value of the money obtained or sought to be obtained is or exceeds $5,000.\n(b) A violation of Subsection (2)(b) is a class A misdemeanor.\n(4) An actor under this section may include an officer or agent of an employing unit as defined under Section 35A-4-202.","path":["Title 76 Criminal Offenses","Chapter 76-8 Offenses Against the Administration of Government","Part 76-8-13 Unemployment Insurance Fraud"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter8/76-8-S1303.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"343d3f1ea65dc47e8404caff10bfc5fc4a904ba5eb49740e4c336b4c45c9006b","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-8-1302","next":"us-ut/utah-code-76-8-1304"},"notice":"GroundRules: Original legal text.
