{"data":{"id":"us-ut/utah-code-76-8-301","jurisdiction":"us-ut","citation":"Utah Code § 76-8-301","heading":"Interference with public servant.","body":"(1)\n(a) As used in this section:\n(i) \"Constable\" means an individual:\n(A) acting at the direction of a city, as described in Section 10-7-87;\n(B) acting at the direction of a county, as described in Title 17, Chapter 78, Part6, Constables;\n(C) who is visibly identifiable as a constable and who identifies himself or herself as a constable; and\n(D) who, beginning January 1, 2027, is licensed as a constable under Title 58, Chapter 91, Constables Licensing Act.\n(ii) \"Public servant\" does not include a juror.\n(b) Terms defined in Sections 76-1-101.5 and 76-8-101 apply to this section.\n(2) An actor commits interference with a public servant if the actor:\n(a) uses force, violence, intimidation, or engages in any other unlawful act with a purpose to interfere with a public servant performing or purporting to perform an official function; or\n(b) obstructs, hinders, conceals, or prevents the lawful service of any civil or criminal legal process by a sheriff, constable, deputy sheriff, deputy constable, peace officer, private investigator, or any other person authorized to serve legal process.\n(3) A violation of Subsection (2) is a class B misdemeanor.","path":["Title 76 Criminal Offenses","Chapter 76-8 Offenses Against the Administration of Government","Part 76-8-3 Obstructing Governmental Operations"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter8/76-8-S301.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"ddd65d835b782a8e225031b08543d95c4ee27bac3ff87258331f3d3e1d1c835e","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-8-203","next":"us-ut/utah-code-76-8-301.2"},"notice":"GroundRules: Original legal text.
